Terms & Conditions

Last Updated: 12 June 2025  |  Effective Date: 12 June 2025  |  Verrik Horal, George Town, Pulau Pinang, Malaysia

1. Definitions

In these Terms and Conditions, the following terms carry the meanings set out below:

2. Acceptance of Terms

By submitting a piece for assessment, by confirming agreement to a Written Scope, or by using this website, you agree to be bound by these Terms and Conditions. You must be at least 18 years of age and legally capable of entering into a binding agreement. If you are acting on behalf of a third party, you warrant that you have the authority to do so.

3. Service Description

Verrik Horal offers workshop-based watch repair and maintenance services. The three principal areas of work are:

Services are available to customers in Malaysia. Customers outside Malaysia may enquire regarding postal intake; transit arrangements are discussed and agreed separately. We do not accept postal intake without prior written agreement.

4. Intake and Assessment

All pieces are assessed before any work is proposed. The initial assessment carries no charge and places no obligation on either party. Following assessment, Verrik Horal will provide a Written Scope. Work commences only after the Customer has confirmed agreement to the Written Scope in writing (including by email or SMS confirmation).

Where assessment reveals a requirement for work not listed in our principal service areas, we will advise honestly on whether such work falls within our capabilities. We reserve the right to decline work that is outside our scope.

5. Written Scope and Scope Changes

The Written Scope constitutes the agreed description of work. No alteration to an original dial, no repainting, and no substitution of original components will be made without specific written consent, even where such alteration might produce a better functional result.

If, during the course of a job, an unexpected condition is found that would require work beyond the Written Scope, Verrik Horal will contact the Customer before proceeding. Additional work proceeds only with confirmed Customer agreement. No additional charges will be added to the final invoice that were not discussed and agreed during the job.

6. Pricing and Payment

All prices are stated in Malaysian Ringgit (RM) inclusive of applicable taxes. The prices listed are per piece. Payment is due on collection of the piece. For heritage movement rebuilds, a deposit of 30% of the quoted price may be requested before work commences; this will be noted in the Written Scope where applicable.

Payment methods accepted include cash and bank transfer. A receipt is issued for all payments.

Where parts must be sourced for a heritage rebuild and their cost is agreed separately during the job, these costs are added to the final invoice at the agreed price, not at a marked-up rate.

7. Timelines

Timelines stated in service descriptions are typical ranges and are not contractual commitments. For heritage movement rebuilds, timelines are set case by case and stated in the Written Scope. Verrik Horal will notify the Customer if a job is expected to exceed the stated timeline due to parts sourcing or unforeseen complexity. We do not accept liability for inconvenience arising from timeline variations within a reasonable range of the stated estimate.

8. Care of Pieces in the Workshop

Pieces in our care are stored securely between work sessions. Verrik Horal carries workshop liability cover for pieces in our possession, subject to the terms of that policy. In the event of loss or damage to a piece while in our care, we will notify the Customer promptly and address the matter through our insurer.

Customers are advised to declare the insured or replacement value of a piece at intake if it is significant. We do not accept liability beyond the declared or assessed value of the piece.

9. Collection and Uncollected Pieces

The Customer will be notified when a piece is ready for collection. If a piece is not collected within 60 days of notification, Verrik Horal reserves the right to charge a storage fee. After 180 days from notification, uncollected pieces may be disposed of to recover outstanding costs, subject to a final written notice to the Customer at the contact details provided at intake.

10. Disclaimers

Watch repair and maintenance involves working with aged mechanical components. Verrik Horal operates with appropriate care and skill; however, we cannot warrant that all work will achieve a specific rate accuracy or that no further issues will arise with a piece after service, particularly where the piece has pre-existing age-related deterioration that falls outside the agreed scope.

No guarantee of specific timing performance is given unless expressly stated in writing. A rate measurement result, where provided, describes the performance observed at the time of measurement and does not constitute a long-term performance commitment.

11. Limitation of Liability

To the fullest extent permitted by Malaysian law, Verrik Horal's liability in connection with any Service is limited to the price paid for that Service. We are not liable for indirect, consequential, or special losses, including but not limited to sentimental value, loss of use, or commercial loss.

Nothing in these Terms excludes liability for personal injury or death caused by negligence, or for fraud or fraudulent misrepresentation.

12. Intellectual Property

All content on this website, including text, photographs, and design, is the property of Verrik Horal or is used with permission. You may not reproduce or redistribute any part of this website without our prior written consent.

Condition dossiers and photographic records produced by Verrik Horal for a specific piece belong to the Customer upon payment of the applicable service fee.

13. Indemnification

You agree to indemnify and hold Verrik Horal harmless from any claim, loss, damage, or expense (including reasonable legal costs) arising from your breach of these Terms, or from any inaccurate information you provide at intake that affects the outcome of the work.

14. Termination

Either party may terminate an agreed job before work has commenced, without penalty. If work has begun, the Customer is liable for costs incurred to the date of termination, including any parts already ordered. Verrik Horal may decline to accept a piece for intake at our discretion and without obligation to provide reasons.

15. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from or relating to these Terms or to a Service provided shall first be referred to informal resolution by direct communication between the parties. If informal resolution is not achieved within 30 days, either party may refer the dispute to the courts of Malaysia, with jurisdiction in Pulau Pinang.

Consumer rights under the Malaysian Consumer Protection Act 1999 are not affected by these Terms.

16. General Provisions

These Terms, together with any applicable Written Scope, constitute the entire agreement between the parties in respect of the Service to which they relate. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect. Failure to enforce any provision does not constitute a waiver of the right to enforce it in future.

17. Changes to These Terms

We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. For jobs agreed under an earlier version, the Terms in effect at the time the Written Scope was agreed apply.
